2021 | 06/16 | In line with judicial interpretation No. 791 of the Judicial Yuan, the provision under Article 239 of the Criminal Code which stipulated that “spouses who engage in adultery and their adultery partners shall be sentenced to imprisonment of less than one year” was invalidated on the grounds that it violates the constitutionally guaranteed right to self-determination as well as the principle of proportionality set out in Articles 22 and 23 of the ROC Constitution, and the provisions regarding the legal intent to commit adultery were revised accordingly. As per Ordinance Hua-Zong-Yi-Yi-Zi No. 11000055341 issued by the President on June 16, 2021, the relevant provisions under Article 245 of the Criminal Code were also amended and Article 239 was deleted. |
06/25 | During the most severe period of the COVID-19 pandemic, the 13 articles of the Special Judicial Procedural Act during the Epidemic Period of a Communicable Disease were finalized and promulgated as per Ordinance Hua-Zong-Yi-Yi-Zi No. 11000058791 issued by the President on June 25, 2021 in order to ensure the effective implementation of judicial procedures, safeguard the right of litigants to a fair and rapid trial, and preserve the health and safety of participants in such proceedings. This Act took effect on the date of promulgation but subsequently expired on June 30, 2023, and its extension is subject to approval by the Legislative Yuan. |
